Should I have a title insurance company or an attorney represent me during a closing?

It is important to know that title insurance companies cannot represent any party during the closing process. Realtors often suggest using a title insurance company because it is convenient to them, but only an outside real estate lawyer can represent you. Our prices match title company prices, so you do not have to worry about finding an attorney at an affordable price.

Do I need a lawyer during the closing process?

Florida does not require an attorney during the closing process, but it is helpful if you have one help draft, review, and translating the contract. If necessary, we can also help negotiate the terms of the contract.

Do I need title insurance?

If you are financing your purchase, you will need title insurance to guarantee the mortgage amount offered.

How much is title insurance?

Title insurance is not as expensive as you may think-it is often one percent or less of the cost of the property. Unlike other types of insurance, title insurance is only paid one time, often during settlement.

Do I need to be at my closing?

It is not necessary for you to be present at your closing, but can be helpful to you if you are able to attend. Otherwise we can communicate with you via email or mail regarding your closing.

Why is transferring real estate different than transferring other objects?

Since most forms of real estate transactions are not permanent and can therefore have various owners throughout the years, certain types of rights may have been obtained by other owners prior to you purchasing it. To transfer a clear title to a piece of land, you must discover if any rights are outstanding.

What is a title search?

A title search examines past records of a property. Such records include any deeds, court records, property and name indexes, and various other documents. A title search must be run in order to verify the seller's right to transfer ownership to you, as well as uncover any claims or defects.
