How Florida Law & Lee County Probate Affect Your Plan
Florida law can affect who receives a primary residence, what rights a surviving spouse holds, and which assets become part of probate. Probate is the court-supervised process for identifying estate property, addressing valid obligations, and distributing the remaining assets. Lee County proceedings move through the circuit court, and our attorneys are familiar with matters in the Lee County and Collier County court systems.
Florida Homestead Rules
Florida homestead protections can restrict how a primary residence is transferred when an owner is survived by a spouse or minor child. The correct analysis depends on occupancy, ownership, marital status, family circumstances, and the proposed transfer. These issues should be reviewed before finalizing a will, trust, or deed.
Rights of a Surviving Spouse
A surviving spouse may have an elective-share right, which is a statutory claim against certain estate interests rather than the distribution stated in a will. The elective share is generally 30 percent of the elective estate under Florida law, but determining which assets count and how the share is satisfied depends on the facts.
Probate & Nonprobate Transfers
A will generally controls only assets subject to probate. Jointly owned property, trust assets, and accounts with valid beneficiary designations may pass through other arrangements. We review these components together so your documents and transfer instructions reflect the same distribution plan.
