WHAT IS PROBATE?
Probate is a court-supervised process for identifying and
gathering the decedent's assets, paying taxes, claims of creditors
and expenses, and for the distribution of the decedent's assets to
the beneficiaries. However, not all assets are subject to probate.
Only assets that are in the decedent's sole name at death, which
contain no provision for automatic succession of ownership, are
subject to probate.
